An extra year to start using the UKCA marking

The UK Government plans to postpone the UCKA marking by one year

After Brexit, it was introduced the new UK Conformity Assessed (UKCA) marking. It will replace the CE mark, the product safety labelling used by the European Member States, guaranteeing UK to have control over goods regulation and to maintain high product safety standards.

Moreover, UCKA mark will also replace the EU aerosol product symbol, ‘reverse epsilon’ marking.

In order to allow businesses to adapt to the new provisions, the UK Government provided a transitional period, during which CE marking may still be used for products intended for the British market.

Initially the end of the transitional period was foreseen for the 31st of December 2021. However, considering the impact of the pandemic on businesses, the deadline to apply UKCA marks has been extended to 1 January 2023.

Thus, all goods which previously required CE marking, do not need UCKA marks until 31st December 2022, as long as the applicable European legislation requirements remain the same as those in the United Kingdom.

From 1 January 2023, therefore, all products placed on the UK market and subject to UKCA marking, will have to adapt to the new brand. An important exemption is that of medical devices; businesses will not need to use the UKCA marking until 1 July 2023.

Northern Ireland will continue to recognise the CE marking. Only if an UK Conformity Assessment Body is used, they must use the UKNI marking.

To extend the deadline, the UK Government will introduce a statutory instrument under section 8 of the EuropeanXWithdrawal Act in the next few months.
